Policy Terms & Agreement of Services

*This Policy below is sent to your account when you sign up.  It is on our web site for review.

In order to effectively continue our services for Royal Oak Internet we have set forth the following terms and conditions which shall govern this Agreement between the parties. These terms and conditions are intended for the purpose of establishing operating principals.

CPU USAGE

The Customer agrees that it shall not use excessive amounts of CPU processing on any of Royal Oak Internet servers. Any violation of this policy may result in the Customer's immediate termination at the sole discretion of Royal Oak Internet without prior notice. In the event that Royal Oak Internet elects to terminate the Customer on this basis, the Customer shall be entitled to a refund.

UNLIMITED USAGE POLICY

Unlimited usage. This means as long as the Customer is at the keyboard or downloading a program the practice is acceptable. This is not intended to be a full-time unattended connection. Customer agrees not to provide any public information services over this connection, not to use any automatic method to avoid inactivity disconnect, and to keep the connection active only when the member is actively using it. A few individuals holding a modem connection for long periods of time increase the possibility of other users being unable to gain access.

BULK E-MAIL / SENDING UNSOLICITED EMAIL - SPAMMING / ADULT CONTENT / NO HATE CONTENT

It shall not be permissible for the Customer to engage in any bulk E-mailing or use of mail servers or mail relays (commonly referred to as "SPAMMING"). In the event that the Customer engages in such activity, Royal Oak Internet may elect to immediately terminate the Customer at its sole discretion without prior notice to the Customer. In the event that Royal Oak Internet terminates the Customer due to this provision, the Customer shall NOT be entitled to a refund. "Sending and/or Forwarding" any amount of unsolicited email shall be considered "spamming". The Customer shall be liable for any and all damages caused as a result of the Customer's failure to comply with this provision. Using any mail server or mail relay to send out unsolicited email is in violation of our usage policy. Our definition of "unsolicited email" is defined as: If you send an email to someone that did not directly ask for you to send them any type of promotional information, images, attachments, hyperlink(s) or auto-forward(s) that reveal promotional content of any kind is considered unsolicited email and violates our policy. You cannot host web sites or web site files for spammers (this means you can't use an outside spammer service (sending of unsolicited email) to promote your local web site or server which resides on our network.) Knowingly or unknowingly. Providing an "unsubscribe link" at the bottom of the emails will not necessarily exclude you from our policy. Warnings issued from Royal Oak Internet should not be taken lightly. We urge our colocation customers to actively pursue any arising issue as soon as possible. Under no circumstance do we allow "Adult Content" of any type. If you violate our "No Adult Content" policy your account may be terminated without notice with option for no refund. Adult content is "nudity of any type" and is subject to review by Royal Oak Internet management. No Hate Email or Content allowed. This is subject to review by Royal Oak Internet management.

RECOMMENDATIONS & WARNINGS

As a Royal Oak Internet Customer please feel free to contact us with any questions or concerns regarding the sending of email. When obtaining email lists we recommend signing up for use of our List Server Services. This requires that you have a Web Site Hosting package from Royal Oak Internet. You can opt for using an outside List Server company, just be sure to ask how they acquire their email lists.

To avoid termination of your account do not purchase or obtain email lists from any outside sources such as downloaded lists, CD's or DVD's with hundreds, thousands or millions of email addresses claiming that all the email addresses want to be sent promotional information of any kind. We found this to be false. We will hold you responsible for sending the unwanted email to such lists. Any bulk email sent out from another network that is unwanted by the recipient which contains promotional information of any kind will still be a violation of our policy if it appears to be sent on behalf of you or your company.

TERMINATION

Either party may terminate this Agreement without cause upon 30 days written notice to the other party. E-Mail shall be deemed adequate notice by either party. Nothing in this paragraph however shall limit Royal Oak Internet's right to terminate the Customer immediately and without prior notice for improper use and violations as set forth herein. In the event that Royal Oak Internet elects to terminate the Customer as a result of its improper acts and breach of the terms and conditions contained herein, the Customer shall not be entitled to a refund of the balance. Hosting customers that do not use our name servers for Royal Oak Internet hosting packages will be seen as leaving our hosting services and will be shutoff. In no event shall the Customer be entitled to a refund of any setup fee. In the event the Customer elects to terminate this Agreement, same shall be considered a breach and the Customer shall not be entitled to any refund. In the event that Royal Oak Internet elects to terminate the Customer without cause, the Customer shall receive a full refund of any balance. However, if the Customer terminates this Agreement without cause, and in accordance with the notice provision set forth herein, there shall be no refund of any setup fee or any remaining balance.

LIABILITY

The Customer agrees that Royal Oak Internet shall have no liability for the services, data or information provided to the public on the Internet including but not limited to any liability for consequential, indirect, special or incidental damages, regardless of the success or effectiveness of other remedies. The Customer further agrees that Royal Oak Internet shall not be liable for any damages or losses sustained by the customer for business or other activities conducted on the Internet including but not limited to consequential, indirect, special or incidental damages. The Customer agrees that it shall not hold Royal Oak Internet liable for any loss of business, lost opportunity, consequential, indirect, special or incidental damages as a result of any interruption in service. In no event shall Royal Oak Internet's liability exceed the total value paid to Royal Oak Internet by the Customer.

REPRESENTATION AND/OR WARRANTIES

Royal Oak Internet makes no representations and cannot guarantee that the Customer's domain name does not infringe upon any trademarks, trade names, service marks or other proprietary rights owned by a third party. The Customer shall not hold Royal Oak Internet liable for any damages, injuries or losses incurred by the Customer as a result of any action instituted by a third party.

SECURITY

The Customer understands that the Internet and other various networking connections including Royal Oak Internet are not secure, unless explicitly specified as such. Royal Oak Internet makes no warranties of any kind, either express or implied. In no event shall Royal Oak Internet be liable for any damages or losses, either consequential, indirect, special or incidental incurred by the Customer.

INTEGRITY OF INFORMATION

The Customer is solely responsible for validating the integrity of the information and data it receives or transmits over the Internet.

ACCOUNT SECURITY

The Customer shall be solely responsible for protecting the security of its Internet account and usage. The Customer's password shall be considered private information and shall not be disseminated or in any other manner disclosed and/or transferred to third parties. Royal Oak Internet shall not be liable for any breach of security caused by the Customer or third parties. Royal Oak Internet will use its best efforts to maintain the integrity and security of the Customer's password.

DOMAIN NAME OWNERSHIP

The Customer shall be responsible for all costs and fees associated with its domain name including, but not limited to all costs and fees for moving same. New domain name registration's are processed by Royal Oak Internet only when payment is received. After the domain name registration fee expires the Customer shall make payment directly to the issuer. Royal Oak Internet will forward any and all renewal notices for said domain name. Under no circumstances shall Royal Oak Internet be responsible for new domain name or renewal domain name costs.

*Please keep in mind, all trademark and copyright research is done by the individual company or client that is requesting the domain name. If you need an attorney reference please contact us at (248) 541-8886. This research should be done before we process your domain name. Step one is to search if a domain name is taken (call us for possible availability). Then call your attorney to check for any conflicts regarding the domain name.

*Royal Oak Internet is not responsible for any research or legal fees regarding your desired domain name.

LEGAL ACTION

The Customer agrees to indemnify and hold Royal Oak Internet harmless in any legal action which arises as a result of the Customer's use of Royal Oak Internet services, without limitation or exception including, but not limited to any action brought against the Customer by a third party.

HEADINGS

Headings in this Agreement are for convenience only and shall not be used to interpret or construe these provisions.

WEB HOSTING / WEB SPACE

Web Hosting customers must send in payment(s) by payment due date which is printed on invoice. Services may be temporarily halted until payment is received. To avoid disruption of services please be sure your payments are received on time. Monthly paying customers who are delinquent with payments will get email late notices only. Hosting customers that do not use our name servers for Royal Oak Internet hosting packages will be seen as leaving our hosting services and will be shutoff. If your commercial web hosting account exceeds the allowed amount of space you will be contacted to increase your hosting payment fee or lower the space by removing files. Personal web pages are only allowed 5MB of space.  Under no circumstance do we allow "Adult Content" of any type. If you violate our "No Adult Content" policy your account may be terminated without notice with option for no refund.  Adult content is "nudity of any type" and is subject to review by management. Hosting and Email customers on our equipment will be suspended without notice if customer uses non-Royal Oak Internet DNS name servers.

INTERNET ACCESS CUSTOMERS - AGREEMENT

• I agree to not hold Royal Oak Internet liable for any information, materials or subjects contained on the Internet.
• I agree with the information on this page and authorize any chosen payment option that was presented to me during sign up.
• Refund Policy: If you decide to terminate your account with Royal Oak Internet, the time used will revert to the monthly fee of $19.50 or whatever monthly fee you have (i.e.: $39 per month for 128K ISDN) and then you will be refunded the balance. We do not pro-rate refunds on a daily basis. Each account is rounded off to the next month in the following manner: If you used your account for 30 days or less it is considered 1 month used. 31 days is considered 2 months used. This is a 30 day billing cycle.
• Service is activated when payment is received.
• Returned checks have a $15.00 service charge.

OTHER AGREEMENTS

The terms and conditions of this Agreement may be modified at the discretion of Royal Oak Internet within 30 days notice to the Customer.

MODIFICATION

The terms and conditions of this Agreement may be modified at the discretion of Royal Oak Internet without any notice to the Customer. Our current Policy is always viewable on our web site.

ENTIRE AGREEMENT

This Agreement supersedes all Agreements previously made between the parties pertaining to the subject matter of this Agreement. There are no other understandings or Agreements. Failure to properly notify Royal Oak Internet via e-mail, telephone or regular mail of your disagreement with the above terms and conditions will constitute the Customer's acceptance of same. This Policy is sent out to all Web Hosting customers.
